Any sale contracted electronically with our company on the site ricalewis.com is subject to these general conditions of sale. They can be viewed in French and printed following the instructions on the customer's Internet browser.

ARTICLE 3 – CONSUMER INFORMATION

The customer receives the information provided for in articles L 121-18 and L 121-19 of the Consumer Code, before and after the conclusion of the sale and in particular by these general conditions of sale of which he declares to have read before validation of his order and to which he has access from the site ricalewis.com.

Photos of items for sale on the site ricalewis.com have no value and may vary slightly from the items themselves.

ARTICLE 4 – PRICE AND CONDITIONS OF VALIDITY

The services of the ricalewis.com site are offered in Metropolitan France, Corsica and Monaco, and in French.

The prices of products sold on the site ricalewis.com indicated by item and reference and are inclusive of all taxes (TTC), delivery costs included.

At the time of validation of the order, the price to be paid by the customer means the all-inclusive price, i.e. the sum of the price including tax of the items which make up the order, including delivery costs.

The connection costs inherent in accessing the site remain the responsibility of the customer.

The conditions of validity of our product and price offers are determined by updating the site when our collections or promotions are released and remain applicable as long as they remain accessible by us.

Delivery times will be indicated before final validation of the order.

The products on sale on the ricalewis.com website are available while stocks last. If one or more items are no longer available, no size will be displayed on the product sheet, informing the customer of its status (available or not).

If the item or items ordered become unavailable after placing the order, Rica Levy International will inform the customer by email or post. The order will be automatically canceled and the customer refunded immediately.

ARTICLE 5 – STEPS IN CONCLUSION OF THE SALE

1- Dial the address ricalewis.com.

2- Follow the instructions on the site.

3- Follow the instructions necessary to open a customer account.

4- Fill out the order form.

5- Check the elements of your order, identify and correct any errors made during entry.

6- Validate the order, the total price of all items ordered excluding delivery costs and the all-inclusive price, that is to say of all items, delivery costs included, by clicking on “Order” to pay.

7- To make secure payment for your Rica Lewis order, follow the instructions on the secure payment server of our partner OGONE. Your bank account will be debited for the all-inclusive price including the total price of the items shipped and delivery charges.

8- You receive electronically an acknowledgment of receipt serving as confirmation of your order.

9- You receive electronically a shipping confirmation of your order. If you have chosen to be delivered via La POSTE, “Colissimo” services, a link to the site www.colissimo.fr to track your package will be sent to you.

10- You receive your package at the delivery address you indicated when ordering.

When establishing the account opening form, communicating his personal data, his bank card number and the confidential data relating thereto and validating the order, the customer undertakes to respect of these contractual conditions in application, the communication of these elements by electronic means constitutes proof of its consent and its commitment in application of article 1316-1 of the civil code.

Rica Levy International may refuse to honor any order that is abnormal or abusive.

ARTICLE 6 – SECURE PAYMENT

Payment for customer purchases is made by French bank cards.

In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing his bank card number and the above-mentioned information, the customer authorizes the company Rica Levy International to debit his credit card for the total amount including tax of his order (delivery costs included).

The customer's bank card is debited upon validation of payment for the order.

To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on this bank card to be debited is indeed his own then communicates in a secure environment on the site of our payment partner OGONE, the sixteen-digit number and the expiration date, appearing on the front of their bank card, as well as, where applicable, the numbers of the visual cryptogram appearing on the back of their bank card.

The customer certifies having the necessary authorizations to make payment by credit card. In the context of payment by bank card without authentication, the payment order may be repudiated in the event of fraudulent use of the card, in accordance with the contract concluded between the customer and his banking establishment.

Rica Levy International reserves the freedom to verify the personal data provided by the customer and to adopt the measures it deems necessary (request for supporting documents and/or cancellation of the order) to verify that the person whose bank account is debited is the one who placed the order and thus avoid any fraudulent use of bank card numbers on its site.

The products ordered remain the property of the company Rica Levy International until full payment of the invoice.

OGONE is the only one, through its secure space, to have knowledge of the customer's banking information. This information does not pass through the site ricalewis.com in any way.


ARTICLE 7 – SHIPPING AND DELIVERY

When entering their order, the customer must choose the delivery method offered on the e-store and the delivery location. The customer can choose to be delivered to their home (or to their office, to a third party or to their vacation spot) or to a So Colissimo relay point by La Poste. In all cases, the place of delivery must be located in Metropolitan France, Monaco and Corsica. Delivery is made within 72 hours from the day after the order date (excluding Saturday, Sunday and public holidays). Delivery is free for all orders.

In the event of absence during a Colissimo delivery to the address indicated by the customer, a delivery notice is left by the carrier: the customer can then collect their package from the post office provided with an identity document within 15 days following the date of filing of this notice. After this period, the package will be returned to the company Rica Levy International. The Rica Levy International e-boutique Customer Relations Department will then contact the customer for a possible reshipment at their expense or, without a response from the customer, a refund of the order (excluding delivery costs).

When a package leaves the warehouses of the company Rica Levy International to be sent to the address indicated by the customer when ordering, the latter receives electronically from the site www.ricalewis.com shipping confirmation on which indicates the tracking number of the package.

The customer can follow the progress of the processing of his order in his secure personal space “MY ACCOUNT” accessible on the site www.ricalewis.com or by going, with his parcel tracking number, to the site Internet made available by the Post Office.

Each delivery is deemed to have been made as soon as the product is made available to the customer, evidenced by the delivery tracking offered on the Post Office website mentioned above.

If 5 working days after dispatch of the package, the customer has no news of his order, he must contact the company Rica Levy International through the RICA LEWIS e-boutique Customer Relations Service which will then open a survey of La Poste services.


Rica Levy International is then bound by the response times of La Poste.
- If the package is found, it is sent to the customer: the reception procedure then follows its normal course (deposit of the package or delivery notice)
- If the package is declared lost, Rica Levy International then notifies the customer and immediately reimburses the package (products and shipping costs)

The following are considered in particular as cases of force majeure relieving the company Rica Levy International of its obligation to deliver: war, riot, fire, flood, strikes, accidents, inability to be supplied. .

In any case, delivery of our products on time can only occur if our buyers are up to date with their obligations to us.

It is the customer's responsibility to check shipments upon arrival and possibly refuse the package if it is likely to have been opened or if it shows obvious signs of deterioration. If the customer receives the package and notices that the goods have been damaged, he must send his complaints by registered letter with acknowledgment of receipt to Rica Levy International, within 3 working days, not including public holidays, following delivery of the products.

The customer must ensure that the items delivered to him correspond to his order. In the event that the items delivered do not conform in nature or quality to the specifications indicated in the delivery note, the customer must return the items to the address and under the conditions provided for in article 8.

ARTICLE 8 – RETURN POLICY

In accordance with the consumer code, Rica Levy International grants the customer a cooling-off period. This is 14 clear days from delivery to reconsider the purchasing decision and return the item(s) ordered.

In addition, because we want the customer to be completely satisfied with their purchases on our e-store, the customer has the possibility of returning the product(s) they purchased within 30 days following the date of receipt. Beyond this 30 day period, no returns will be accepted.

In all cases, the items must be returned in their original packaging, complete, labeled, new, unworn, unwashed. The return package must be sent to the following address with a copy of your invoice/delivery note:

Returned items which do not meet the conditions listed above (return in their original packaging, complete, labeled, new, unworn, unwashed above) or which are damaged, damaged, deteriorated or soiled by the customer will not be refunded.

Return costs and risks are always the responsibility of the customer. The customer is therefore strongly encouraged to return the package by any means which provides proof of its sending and gives it a certain date (recommended with acknowledgment of receipt, colissimo tracking, etc.).

Refund conditions for returned products and coverage of return costs

Once the goods have been received, checked and accepted by our services, reimbursement for returned items will be made by bank transfer, no later than 30 days following receipt of the return. In accordance with the Hamon law, if all items in the order are returned, the shipping costs paid for this order are fully refunded. In the event of partial return of the order, shipping costs are not refunded.

If the return is due to an error on our part, the “outbound” and “return” delivery costs which were paid by the customer will be refunded. In all other cases, the costs of returning the items are the responsibility of the customer.

Please note: Products purchased on the e-boutique cannot be the subject of a credit.

An exchange is possible, the customer will simply need to contact the RICA LEWIS e-boutique Customer Relations Department, who will do the necessary after receipt of the product initially ordered.

ARTICLE 9 – GUARANTEE AND LIABILITY

The specific warranty conditions given to the customer with the item delivered and the items sold on the site www.ricalewis.com are subject to the warranty conditions provided for by law.
In the event of non-compliance of an item, the customer may choose, after returning the product under the conditions of article 8, to either be delivered a product or item identical to that ordered within the limits of available stocks, or be delivered with an item of equivalent quality and price within the limits of available stocks, or be reimbursed for the item ordered within 30 days of its request.

The costs of returning the non-compliant product, as well as the delivery of another replacement product, will be the responsibility of Rica Levy International.

These provisions do not deprive the customer of his right of withdrawal provided for in article 8.

Rica Levy International cannot be held responsible for:
- in the event of failure to fulfill contractual obligations due to a fortuitous event or a case of force majeure
- in the event of non-substantial differences between the photos, texts and illustrations of the articles on our site and the articles ordered.

In accordance with the GDPR law (Regulation of the Management of Personal Data) of May 25, 2018, personal data is used to manage the consumer's online purchase. ARTICLE 12 – APPLICABLE LAW

These general conditions of sale and the commercial relationship between the company Rica Levy International and the customer are governed by French law. Any dispute relating to the commercial relationship between the company Rica Levy International and the client will be subject to the jurisdiction of the French courts.

ARTICLE 13 - COMPOSITION OF PRODUCTS

Information relating to the composition and/or instructions for use of the Products is available on the information sheet for each Product.
In accordance with the provisions of the Environmental Code and the AGEC law combating waste and in favor of the circular economy, Rica Levy International has affiliated with eco-organizations for the management and sorting of its waste. For this purpose, Rica Levy International has the necessary unique identification numbers (IDU: FR219086_11OYOB). The Client can consult the management and sorting rules from each actor.
Rica Levy International undertakes to deliver Products that meet the requirements in force relating to the safety and health of people in accordance with European provisions, and in particular the legislation on chemical substances with regulated contents.
The Customer is solely responsible for the choice of products, their conservation and their use.
